Helping Families and Small Businesses with Legal Concerns in the Twin Cities Metro area MNEstate Planning

We will help you put an estate plan in place to govern the orderly distribution of your assets upon death, or provide for the care of your minor children. We will review or prepare all the documents required to put your plan in place, including wills, codicils, trusts, powers of attorney, standby guardian, parental powers of attorney or nomination of guardians and healthcare directives.

If appropriate, we may be able to assist you in using Transfer on Death/Pay on Death (TOD/POD) designations, joint tenancy, beneficiary designation and Transfer on Death deeds to accomplish your estate plan without requiring a probate.

If you need a special needs trust or a supplemental needs trust to protect the assets of a disabled loved one, we can assist with that.

Probate Administration

If you have been named as personal representative (sometimes called executor) in a loved one's will or are entitled to be appointed as personal representative we can help you comply with the requirements of the probate process so that you can settle the estate of a loved one.

If you are not the personal representative but need representation in connection with a probate or advice concerning your rights in a probate matter, we can help with that. Sometimes, problems experienced by heirs or devisees can be handled without litigation and sometimes litigation is required.

If the loved one had planned ahead and established a trust, we can advise you on trust administration or your rights as a trust beneficiary.

If you have questions about Transfer on Death/Pay on Death (TOD/POD) designations, joint tenancy, beneficiary designation and Transfer on Death deeds or Affidavits of Collection, we can answer those questions and assist you.

We also advise adult children, parents or other relatives of a disabled person who need to set up a conservatorship or guardianship for a person who lacks the capacity to manage his or her affairs. We can assist in the administration of the conservatorship or guardianship. We can also provide representation for relatives of persons who are or may be subject to a guardianship or conservatorship to make sure that relatives' concerns are addressed.
